Committee recommends conditional use permit for outdoor storage site with conditions

The Polk County Planning and Zoning Committee reviewed a conditional use permit application for a 1.6‑acre parcel on State Highway 35 north of Frederick to operate an outdoor storage rental facility using shipping containers and voted to forward the request to the county board with conditions.

Planning staff said the property is commercially zoned and that the proposed development would place units away from a delineated wetland; staff recommended approval if the applicant meets conditions including obtaining all required local and state permits, meeting setback requirements or securing a variance, keeping parking and drive pads on impervious surfaces with on‑site runoff controls, marking property lines near the units so renters and vehicles remain on private property, retaining a vegetated buffer between units and the wetland unless the zoning department approves removal, and limiting the site to no more than 15 units.

The applicant confirmed ownership of adjacent parcels and said the intent is to use the existing concrete pad as a base; staff noted some of the units were placed on site prior to the hearing and that final siting could depend on variance decisions and DOT requirements for driveway use. Committee members discussed enforcement language for nuisance or illegal activity tied to conditional use permits and heard that revocation remains a discretionary county process. A motion to forward the conditional use permit to the county board (consent agenda) carried on a voice vote.

Next steps: staff will include the permit conditions and DOT exhibit in the county board packet; if the applicant proposes units inside setbacks, they will need a variance and additional permits.
