County counsel reports on BlueRock Quarry appeal, Realtors appeal and Stafford case

County counsel (referred to in the meeting as Malia) provided a litigation update to the committee on Oct. 1 and summarized the status of several pending matters.
Counsel said the BlueRock Quarry appeal — an appeal from the Board of Adjustment to the circuit court — is filed and the committee was directed to intervene as an interested party because the committee’s record is central to the appellate record. "This committee will have a voice in that court proceeding," counsel said; the record has been compiled and forwarded to the circuit court and briefing has not yet started.
Counsel also said the Wisconsin Realtors Association filed an appeal even though earlier communications suggested they would not. That appeal was filed on the final allowable day; counsel described procedural implications but said that even if the Realtors prevail on standing the case would likely return to circuit court for briefing and the county’s next steps would follow the appellate schedule.
On the Stafford matter involving equestrian use of a trail, counsel said appellate briefs have been filed and that there is no restraining order or suspension in place; counsel noted that equestrian use remains restricted per the existing order and that the county is monitoring reports but had only seen one possible pre‑Oct. 1 incident addressed by a DNR warden.
Counsel flagged one pending pro se federal case on a calendar that will extend into 2025 and said staff will update the committee as briefing and schedules develop. Committee members asked clarifying questions; no closed session was requested at the outset because counsel’s summary did not require immediate confidential deliberation.
