Council adopts county transportation impact fee; council amends daycare fee to per‑student basis

Staff and consultants presented an updated transportation impact fee analysis based on the county’s adopted Impact Fee Facilities Plan and an impact fee analysis prepared with Zions Bank. The analysis identified 17 eligible projects to address PM‑peak congestion and calculated a net fee of $3,461.65 per PM peak trip for unincorporated Summit County.

The fee schedule produces different charges by land use because PM‑peak trip generation varies by use. During council discussion members raised concerns that the PM‑peak basis resulted in very high fees for certain daycare configurations (the draft table included a large per‑thousand‑square‑foot figure). Council discussed waiver language in the proposed ordinance and potential outreach to alert applicants to the waiver process.

To address concerns about discouraging child‑care providers, council amended the ordinance to calculate impact for daycares on a per‑student basis using 0.79 PM‑peak trips per student rather than the original square‑foot metric. With that change the council voted to adopt the transportation impact fee ordinance (Ord. 958) for the unincorporated county. Staff noted municipalities are not subject to this county fee and that staff will publish guidance on waivers and the appeal/waiver process for qualifying public‑purpose uses such as affordable housing.
