MSDE presents regulatory‑review work plan; committee recommends forwarding to full board

MSDE presented its Regulatory Review Work Plan for COMAR Title 13A during the Education Policy Committee meeting. Dr. Aileen (MSDE) said the review will assess whether each subtitle continues to be necessary in the public interest, remains supported by statutory authority and judicial opinion, is not obsolete, and is effective. To increase responsiveness, MSDE proposed moving from 2‑year cycles to 2.5‑year cycles and detailed which subtitles will be reviewed in each proposed cycle.
Dr. Aileen described the internal organization for the review: a Regulations Review Coordinating Committee (which includes the Executive Director of the State Board, Zach Hands; a legal counsel from the Attorney General's Office, Amanda White; the Executive Director of Government Affairs; Policy Analyst Laurel Cratsley; and a regulations coordinator). MSDE will use internal staff reviews, a Stakeholder Review Committee appointed by the State Superintendent, and public notices (MSDE website and the Maryland Register) to collect input.
Key dates in MSDE's timeline: staff expect to commence internal review by Oct. 31; local program staff will finalize proposed amendments by Dec. 6; the final internal staff review is scheduled for Jan. 10, 2025; the Stakeholder Review Committee will meet Jan. 10–May 31 and compile recommendations and public comments; and MSDE plans to bring a final evaluation report to the State Board by July 2025 before submission to the Governor and the Administrative, Executive and Legislative Review Committee (AELR) of the General Assembly.
The committee moved and voted to recommend sending the work plan to the full State Board for action. MSDE staff said they will bring the final packet and additional guidance to future meetings as the process moves forward.
