Mason County Fiscal Court adopts land-use rules for medical cannabis and updates administrative code

Maysville, Ky. — Mason County Fiscal Court approved two second-reading ordinances on July 9, adopting new land-use rules for medical cannabis businesses and a set of administrative-code updates.

The court adopted Ordinance 24-04, which amends the county’s land-use charts to establish where different types of medical cannabis businesses may be located, and creates a land-use charge for those businesses. The county said the change responds to the statewide legalization timeline and fills a gap because previous land-use charts did not address medical cannabis operations.

The court also approved Ordinance 24-05, described in summary as a “cleanup” of the Mason County Administrative Code. The changes include updates to comply with KRS 61.397 on required military leave, clarifying health-insurance waiver language for Medicare participants, adding categories of impairing substances, increasing a road-specification bituminous-surface requirement to 1.5 inches, and mandating the use of a standard form for encroachment permits.

Both measures were read by summary during the meeting and approved by roll call. The court did not record substantive amendments during the second-reading discussion. The county indicated economic-development staff have observed statewide interest in medical cannabis ahead of legalization, and county officials said the ordinance provides local rules ahead of that change.
