The Warren County Planning Commission voted to forward a conditional-use permit application for a short-term tourist rental at 345 Donna Court to the Board of Supervisors with a recommendation to approve, subject to staff-recommended conditions.
Planning staff reviewed the application and said the property, purchased in June, is zoned R-1 in Shenandoah Farms Riverview. Staff noted the Warren County Health Department approves a maximum of six occupants for the four-bedroom dwelling and that the applicant proposes to retain a local property manager within the 30-mile requirement. Because the dwelling does not meet the 100-foot neighbor setback, the applicant requested a waiver; adjacent residences sit about 35 feet east and 37 feet west of the subject property.
Staff recommended approval with conditions including: compliance with Warren County Health Department, Warren County Building Inspections and the Virginia Statewide Fire Prevention Code; issuance of a certificate of zoning only after health department records are approved; annual well testing for E. coli and coliform with results submitted to planning and health departments; scheduled septic-system maintenance and pumping every five years with service invoices provided to planning; and granting the setback waiver to reflect existing 35- and 37-foot conditions.
Applicant Jonathan DeHart, who identified himself at the podium as the owner at 345 Donna Court, described the house as a row of eight houses with limited outside living space but strong views suitable for short-term lodging. DeHart said neighbors adjacent to the property had signed off and that accessibility improvements make the house suitable for some visitors with limited mobility.
After a short discussion — commissioners noted the close yard dimensions but also the neighbors' letters of support — Commissioner (speaker 2) moved to forward the CUP to the Board of Supervisors with the staff conditions. The motion was seconded and approved by voice vote. The commission verbally confirmed the application will be forwarded to the Board of Supervisors for final action.
