Midway council adopts ordinance to vacate First Homestead Country Homes plat

Midway City Council voted to adopt Ordinance 2024-16 to vacate the recorded First Homestead Country Homes plat, a 0.45-acre parcel that currently contains four condominium units. Staff presented the application and told the council the units are owned by Homestead Group LLC and that vacating the plat would remove individual tax IDs and prevent the units from being sold separately, effectively converting them to single ownership/hotel-style units.
The city planner explained the procedural standard under state code (plat vacations and plat amendments are treated the same) and recommended findings that no public streets or municipal utility easements would be vacated or altered. He noted the plat dating back to 1976 and amended in 1992 and 2007, described the property layout and garages, and said staff found no conflicts with municipal easements.
Councilmember 4 moved to adopt the ordinance with staff’s proposed findings; the motion was seconded and carried on a voice vote. The council discussed that the vacation must occur before the new plats for phases 1 and 2 can be recorded and confirmed the vacated plat could be reversed later only through a new application and approvals under the city’s master plan, not automatically.
The council action removes the recorded condominium plat, requires recording of replacement plats for the development phases, and leaves any future condominiumization subject to new preliminary and final approvals under the master plan. No additional conditions were included by staff at the time of adoption.
The next procedural step will be recording by the applicant of the replacement plats and any necessary easement paperwork; the city will review those at final plat.
