Commission approves county buildings use with refundable cleaning deposit, directs policy development

The Iron County Commission approved a motion allowing community groups and other persons to use county facilities, including the senior center, subject to a refundable cleaning deposit and department-head oversight.

Commissioner discussion centered on risks and consistency. Legal counsel and county risk staff recommended requiring indemnification language and, where appropriate, proof of liability insurance for events that pose higher risk (for example, large gatherings or events involving alcohol). "At the very least, a statement of indemnification," legal staff said during discussion.

Commissioners directed department heads to implement a provisional fee and deposit schedule (the commission discussed a $500 refundable cleaning deposit), post that schedule publicly and treat groups equitably while county staff draft a more formal countywide policy. The motion passed by voice vote; the commission explicitly authorized department heads to set and collect deposits and apply discretion within posted parameters.

Mark Nelson of the Lions Club told commissioners the organization strives to leave facilities in good condition and supported a refundable deposit approach.

The decision will allow scheduled community events (quilt guild, Lions Club, Ham Radio Club, AA meetings and similar non-profit uses) to continue while the county finalizes uniform procedures, insurance and indemnity forms. County staff said the next step is to prepare written rules, a posted schedule, and a standard waiver form for department review.
