Kane County Commission unanimously approves short-term fire protection agreement with Kanab City

The Kane County Commission voted unanimously on Oct. 8 to approve a short-term contract with Kanab City to provide structural fire protection in unincorporated parts of the county, a measure the board described as a temporary fix while residents and officials continue pursuing a long-term solution.

County officials said the draft agreement includes a $150,000 payment intended to cover up to a year of service and a clause to allow withdrawal from the contract with 60 days' notice so the county would not be required to pay if progress on a permanent solution stalls. The meeting record contains two references to timing: one staff summary said the payment would be due in January if there was no progress, while county counsel and a commissioner referenced a July 1 payment/deadline in explaining how a binding clause would operate.

Commissioner (Speaker 3) told colleagues he had consulted the community attorney and proposed adding a clause "that, after the county has actually made the $150,000 payment... our city would not be able to terminate the agreement. They'd be obligated to continue to provide the fire service till the end of the year." He recommended approving the agreement while allowing the county attorney to make non‑substantive edits to accommodate any minor changes the city council might request.

Other commissioners framed the approved deal as a short-term, stopgap measure. Commissioner (Speaker 2) called it "very much a band aid," saying the contract "buys us another few months so that we can get a real solution in place," and urged residents in unincorporated areas to organize around forming a special service district or similar funding mechanism. Commissioner (Speaker 4) warned that communities without an established local fire station face difficulties with insurance underwriting and may be ineligible for certain interlocal mutual-aid agreements.

The motion to approve the contract, as announced in the meeting, would (1) accept the proposed contract with the county-attorney-recommended language to bind Kanab City after payment, and (2) permit the county attorney to make non‑substantive edits if necessary. The commission voted "Aye" and the chair announced the vote was unanimous.

City council members were scheduled to review the proposed agreement the same evening, and county staff said the commission's approval allows limited flexibility for final, non‑substantive editorial changes. Commissioners emphasized that the agreement does not require Kanab City to expand its fire department personnel; the draft specifies the city's obligation applies "within the limits of the city's reasonably available resources." Mutual-aid arrangements with neighboring departments would remain in place.

The county did not adopt a permanent funding commitment at the meeting. Commissioners described intent to use a special service district in the next tax year to collect funds to cover the payment rather than drawing on general county funds. If residents or the commission do not move forward on a longer-term plan within a few months, commissioners warned the temporary contract could lapse and unincorporated residents could be without structural fire protection.

The meeting ended after the unanimous vote; the commission adjourned at 10:31 a.m. on Oct. 8. The city council's review and any minor edits by the city or county attorneys were left as the next procedural steps.
