Middletown Township supervisors opened and closed a conditional‑use hearing Aug. 12 and approved a four‑day Garden Brothers Circus event slated for Sept. 12–15 in the JCPenney parking area at Oxford Valley Mall (2300 East Lincoln Highway). Solicitor Esposito introduced board exhibits including the application, legal notices and relevant zoning ordinances for temporary community events and carnivals.
Kylie Shepherd, vice president of Garden Brothers Circus, described tented performances running Thursday–Sunday, on‑site RVs for staff, concession and a children’s fun zone with inflatables and pony rides; she said the only on‑site animals besides ponies would be dogs for a dog act.
Director of Building and Zoning Jim Ennis reviewed technical conditions: a traffic circulation plan to avoid interfering with mall operations and nearby attractions, further review by the fire marshal, electrical and building‑code officials, escrow to cover incremental police, fire and emergency services, and waste‑management plans. Ennis said the applicant expects 800–1,000 attendees per performance though the 2,000‑seat tent capacity exists.
No party sought intervenor status and no public speakers opposed the application during the hearing. After staff confirmed prior Planning Commission unanimous recommendation for approval, the board moved, seconded and approved the conditional‑use permit subject to required permits and a $3,000 escrow to cover public‑safety costs during the event.
