Board unanimously approves conditional use for Kansas Foam Insulation at 786 First Avenue

The McPherson County Board of Zoning Appeals unanimously approved a conditional-use permit allowing Kansas Foam Insulation to operate a warehouse/office/home-occupation at 786 First Avenue in Windham, permitting up to five nonfamily employees on the A-1 agricultural parcel.
Zoning administrator John Kinsey presented the case and said the applicant consolidated roughly 10 acres from a larger parcel to run a home-occupation operation. Kinsey reported a sanitation soil survey found that a small septic system would be adequate to handle the additional flow for up to five employees. "Under the conditional use... he told me that he was not gonna do more than 5 and most likely gonna be 3," Kinsey told the board.
Applicant Trevor described plans for an 80-by-100 pole barn with 16-foot sidewalls, parking set back about 50 feet from the road, modest exterior lighting and routine employee movements (arrive in the morning and depart in the late afternoon). He said he reviewed the preliminary report and agreed to the proposed conditions.
During deliberations, board member Shelby Schaum moved to grant the conditional use subject to the conditions in the staff report with deletion of condition 7(c) (the board’s motion specified removing that condition). The motion was seconded and passed by unanimous voice vote. Kinsey said he would draft the resolution and make it available for signature and recording; the board noted that any party aggrieved by the decision may appeal to district court within 30 days after the resolution is filed with the register of deeds.
The panel closed the public portion after the secretary confirmed no written communications were received and no members of the public spoke.
The decision registers the conditional use on the property and allows the applicant to proceed with zoning permitting, subject to the recorded conditions and administrative steps to obtain the zoning permit and complete any required filings.
Next procedural steps include preparation of the resolution for signature, recordation with the register of deeds and issuance of a zoning permit once the applicant completes the administrative steps.
