County staff: outside food vendors can be allowed at permitted-use wineries under current rules

County staff on July 2 told commissioners that Benton County's development code and Oregon law allow food service at permitted-use wineries and do not expressly prohibit the participation of outside food vendors at agritourism events.

"In summary, our reinterpretation of state statute and our code aligns that there is no prohibition in using outside food vendors for agritourism events," said James Wright, associate planner, summarizing his presentation on Senate Bill 841 and related state statutes (ORS 215.452 and ORS 215.283). Wright said neighboring counties (Yamhill, Polk, Marion, Lane and Lincoln) allow food trucks at specified winery events and that the county already requires a five-year renewal for agritourism approvals and environmental health sign-off when food is served.

Commissioners asked how enforcement would work and whether a food truck could operate as a de facto restaurant. Wright said environmental health is part of the approval process: if reports show a food truck is operating outside an agritourism event or exceeding allowed activities, code compliance and enforcement processes would be triggered. He also said staff will reach out to all county wineries to confirm land-use approvals and renewal periods.

The county’s presentation noted several clarifying checks including whether the food is "tailored to wine offering" and whether a winery can produce accounting to show compliance with the 25% non‑wine consumption limit in the relevant statute.

No formal action was required that day; staff said they will contact wineries and track land-use approvals and required renewals.
