Board approves agenda and consent items unanimously, then moves into closed session under FERPA and state statutes
Summary
The McDowell County Board of Education unanimously approved the meeting agenda and consent agenda, then voted to enter closed session citing the Federal Education Rights Privacy Act and General Statute 115C-402E and 115C-319–321 to discuss confidential student and personnel matters.
At the start of the meeting Chairman English called for a motion to approve the agenda. "Is there a motion to approve our agenda this evening?" he asked. A board member moved to approve and another seconded; the chair recorded "we have 8 here" and a remote member voted yes. The motion carried unanimously.
Later the board considered the consent agenda. Ms. Moomaw moved to approve and Mr. Shuford offered a second. After brief discussion the board again voted (8 present) to approve the consent agenda unanimously.
Before adjourning to a scheduled closed session, Chairman English read the statutory bases for the recess, citing the Federal Education Rights Privacy Act and General Statute 115C-402E and General Statute 115C-319–321 to allow the board to consider confidential student and personnel information. A motion to move into closed session was made and seconded; the board recessed to closed session at about 7:12 p.m.
No votes on substantive policy or budget items were taken in open session during that portion of the meeting.
