Linn County commissioners approved a conditional-use permit (CUP 2024-47) that will allow a Pleasanton property owner to store wholesale fireworks in shipping containers on agricultural land, subject to specific conditions aimed at safety and regulatory compliance.
Planning and zoning staff presented case CUP24-07 for applicant Frederick Sandmeier at 9187 Yankee Road and said the proposed storage meets ATF setback requirements and state fire marshal fencing expectations. Staff noted the Board of Zoning Appeals has granted a variance to allow year-round storage; under ATF and local conditions, vendors with more than a thousand pounds of fireworks typically require a conditional-use permit, and the staff recommendation included a three-year permit term and annual inspections.
Staff also said the property would be secured with barbed-wire fencing, security cameras and alarms, and that the owner would provide a key to the local fire department. "With proper conditions, the use will not detrimentally affect the public health, safety, or welfare," planning staff said while recommending approval.
A commissioner moved to approve the CUP and to adopt the Planning & Zoning Committees findings; the motion passed by voice vote.
Next steps: staff will prepare the formal resolution and service conditions, and the applicant must comply with the conditions tied to the three-year permit and annual inspections.
