LCAR approves ambulance services and beneficiary protections rules for Medicaid

LCAR approved two Agency of Human Services rules: ambulance services (treatment without transportation) and beneficiary protections and responsibilities for the Department of Vermont Health Access; agency said changes align rules with the state plan and current practice and received stakeholder input.
The committee unanimously approved two related Agency of Human Services rule filings Sept. 19: rule 24 P25 (ambulance services) and rule 24 P26 (beneficiary protections and responsibilities), both presented by Ashley Berliner, director of Medicaid policy.
Berliner said the ambulance rule was amended to include a definition of “treatment without transportation” and to permit EMTs, AEMTs and paramedics to provide treatment without transport and receive reimbursement, consistent with a state-plan update effective July 1, 2023. She told the committee extensive stakeholder outreach was conducted and no public comments were received during the virtual comment period.
Senator Lyons moved approval for the ambulance rule and subsequently for the beneficiary protections rule; votes were recorded as affirmative and unanimous. Committee members said they did not expect controversial changes and that the rules align program operations with the updated state plan.
Outcome: both rules were approved and will proceed in the administrative process toward adoption.
