The Addison County Regional Planning Commission voted on Nov. 13 to intervene in Vermont Gas’s reapplication for a certificate of public good so the commission can monitor the process and access filings, but the commission did not adopt a position for or against the pipeline at this time.
Committee chairs from the Act 2 50 and Energy committees recommended intervention to maintain access to information after the Public Utilities Commission previously found Vermont Gas had failed to meet certain conditions (notably a burial-depth requirement at a New Haven location), issued a $150,000 fine and later reissued a certificate; opponents appealed and the Vermont Supreme Court ordered the PUC to reopen the matter, prompting a new reapplication. Presenters said intervention would allow the commission and its member municipalities to review independent engineering reports and other materials without committing to litigation or a substantive position.
A motion to accept the committees’ recommendation was made and seconded; the commission approved the motion by voice vote with one recorded abstention (Peter). The chair said intervention will initially be for monitoring and information access, and the commission leaves open the option of taking further steps later if necessary.
