Board hears Title IX policy updates, increased reports and use of administrative hearings

Board staff reported on Title IX developments and training after a KBOR-hosted summer session.
"We had the updates with the new title 9 legislation, that is currently at a stay in the state of Kansas," a Title IX presenter said, describing a work group that is proposing policy revisions to align with the current 2020 federal regulations while state-level litigation or stays remain unresolved. Staff said they will move many campus staff to the role of "responsible employees" for clarity in reporting and will expand outreach and training.
The presenter said the system has seen an increase in reports and has used the Kansas Office of Administrative Hearings for live hearings. "We had our 2 top areas that we investigated and got reports on. This year were stalking, mostly, started in electronic format, social media, and then [an assault-related category redacted in the transcript]," the presenter said. Staff reported four live hearings with outcomes reaching responsible and not-responsible findings to date.
Regents thanked staff for organizing cross-institution training and offered to help ensure systemwide communication as regulations evolve. Staff said they will continue outreach to student groups, ROTC, the marching band and Greek organizations and will connect affected students to resources and support services.
