Crook County tightens hangar lease rules to address FAA compliance concerns

Airport staff presented proposed updates to the county’s noncommercial hangar lease policy intended to address an informal FAA compliance case and to align with FAA sponsor-assurance requirements.

The principal changes described: (1) a clarification that hangar use is for maintenance, repair and refurbishment toward returning an aircraft to operational status, not indefinite storage; staff said documentation or progress reports may be required to establish an expected timeline to become operational; (2) a new lease-extension standard allowing the county to offer a standard lease only if inspections show a structure with a useful life greater than 30 years, and (3) a tool to increase rent to local commercial storage rates if a lessee is out of compliance, with the rent reverting if the lessee returns to compliance.

Staff said the changes were guided by FAA grant assurances and that they would share the edited policy with the FAA as part of an informal compliance response. Commissioners asked how common such policies are and staff said many federally-funded airports include similar sponsor assurances tied to grant conditions. Staff also described an inquiry about a mixed aviation/nonaviation distribution use of a hangar and noted they would seek FAA feedback before advancing that specific proposal.

Next steps: staff will clean up the draft policy language, share it with FAA contacts and place a redlined version on the consent agenda. No formal commission vote occurred during the work session.
