Martinez Unified board approves confidential special-education settlement, backs Prop. 2 resolution and personnel permit

The Martinez Unified School District Board of Education on Oct. 14 reported the approval of a confidential settlement in an Office of Administrative Hearings special-education case and adopted several formal actions, the board said.

The board reported that “on motion of member Anne Horak Martin, seconded by member Carlos Melendez, the board in closed session voted 5 to nothing to approve a confidential settlement agreement in the matter of Martinez Unified School District v. Student OAH case number 2020Four-eight-one70,” resolving a dispute that included educationally related costs and attorney’s fees in exchange for waivers and releases, the board reported when it returned to open session.

At the same meeting the board approved its amended agenda and then took several public action items by voice vote. The district’s initial sunshine proposal to the Martinez Education Association (item 16.1) and the MEA’s reciprocal sunshine proposal (item 16.2) were both approved after staff presentation and brief discussion.

The board also adopted Resolution 20 20 five-eight in support of California Proposition 2, a state general-obligation bond described during the presentation as $10,000,000,000 total with $8.5 billion for K–12 schools and $1.5 billion for community colleges. Board members discussed how state reimbursements would interact with the district’s local Measure O bond and asked staff to clarify reimbursement timing; the resolution was adopted by voice vote.

Finally, the board approved Resolution 20 25-9 to grant a provisional internship permit (PIP) under the California Commission on Teacher Credentialing process to a named teacher for one year, a temporary credentialing pathway that staff said is available when fully credentialed teachers are not in place. Staff noted a teacher may hold a PIP only once in a career and that the teacher will be counted as appropriately assigned while on the permit.
