Violations/Extension: Staff reported that property owners Kevin Ruderman and Nicole Forbes (45 Dartmouth Street, DP 340‑8303) were unable to attend but have engaged consultants and expect to submit a remediation plan by the following Monday; the commission voted to grant an extension and discuss the plan at the Feb. 8 meeting.
Order of Conditions (43 Poole Street): The commission reviewed a draft Order of Conditions for a four‑lot residential subdivision (James Giuliano, 43 Poole Street, DP 3488‑855). Commissioners discussed setting an escrow to guarantee required as‑builts and completion of expected work. After discussion the commission set the bond at $7,500 (suggested midpoint between $5,000 and $10,000) and voted to issue the Order of Conditions as amended.
Emergency certification ratification: The chair described flooding behind homes on Lexington/Garden/Willow streets and reported that DPW found a likely blockage near a manhole and requested emergency certification to act. The commission moved, seconded and ratified the emergency DPW certification and agreed to inspect the completed work and remaining debris controls.
All items were procedural: extensions, issuing the Order of Conditions with a bond amount, and ratification of emergency action. Each will generate follow‑up by staff (plan submission, bond tracking, site inspections).
