WOBURN, Mass. — At its Dec. 10 meeting the Woburn City Planning Board granted a one-year construction-extension for the 24 Flag Street subdivision, approved a $125,000 surety and release of lots for the 43 Pool Street (Winter Road extension) subdivision, and heard staff counsel explain a new state permit-extension provision in recent legislation.
Applicant George Gately Jr. asked to extend the construction-completion date for 24 Flag Street after reporting one house is roughed in. The board voted to extend the completion date to Nov. 15, 2025; the motion passed with six in favor and one abstention.
Attorney Joseph (Joe) Harvey told the board the recently signed state statute commonly referred to in discussion as the Mass Leads law (chapter language cited in staff remarks) includes a permit-extension provision that automatically extends permits issued between Jan. 1, 2023 and Jan. 1, 2025 for two years. Counsel and staff said that could mean some subdivisions are technically extended without appearing before the board and recommended that the city solicitor review the statute to determine the board's administrative options; staff will put that review on the January agenda and consider a simple administrative notice procedure so applicants can claim the statutory extension without attending a hearing.
For 43 Pool Street LLC, attorney James Giuliano reported drainage, sewer and binder coat are in place and asked that the board accept the city engineer's surety recommendation of $125,000 and release the recorded covenants so building permits can be issued once the surety is posted. The board approved the director's drafted motion to establish the surety and release the lots. Planning staff noted building permits will not be issued until the city receives the surety in the agreed form.
The board also discussed how frequently to ask applicants for progress updates when the state extension applies and asked staff to circulate the statute text to board members.
