Counsel David Mindlin presented a revised plan locating two parking spaces alongside the house, arguing the cars would park entirely on the applicant’s property and not in the 10‑foot common passageway. Neighbor Maria Medina and others raised concerns about easement rights and repeated parking on the passageway; board members echoed public‑safety and enforcement worries. The board required multiple conditions: the two tenant parking spaces must be painted on the ground and clearly signed ("Tenant parking only"); the lease for the rental unit must inform tenants there are only two spaces and provide owner contact information; the board prohibited trucks and large vans from using the spaces; and Inspectional Services may issue fines for parking outside approved spaces. The motion passed with negative votes recorded by some members, but the special permit was approved with the stated conditions.
The board noted enforcement of unauthorized parking on the easement is executed by Inspectional Services and that neighbor disputes outside the permit’s scope remain subject to separate enforcement or civil remedies.
