The St. Joseph County Council voted Dec. 10 to rezone roughly 40 acres at the southeast corner of State Road 2 and Strawberry Road from agricultural to commercial under Bill 98-24, approving the measure 9–0 after debate, public testimony and procedural steps to reconcile written commitments with the Area Plan Commission (APC).
Sean Klein of the Area Plan Commission told the council the APC recommended the rezoning subject to two written commitments: that commercial development would be prohibited until the new interchange design at that intersection is finalized and until sewer and water services are available at the site. Klein said those commitments reflect concerns about access, stormwater and sewer availability and are intended to align development with the interchange timeline and utility provision.
Petitioner counsel George Lapiniotis and other proponents argued the commitments would unduly bind the developer. Lapiniotis said limiting the developer until state agencies act could be “unfair” and financially punitive, arguing that developers must be able to begin certain work and that there are alternative utility options such as private wells.
Several residents and local stakeholders spoke in opposition, citing concerns about aquifer impacts, uncertain right‑of‑way and public‑safety setbacks while the interchange design is finalized. One speaker urged the council to “get the thing built right from the start.”
Procedural outcome: Councilmember Drake moved to send the petitioner’s proposed revised written commitments to the Area Plan Commission for ratification; the motion passed and the council then approved Bill 98-24 as amended. APC will consider the modified commitments within statutory timelines and may ratify or return a recommendation to the council.
What passed: The rezoning to C, Commercial District, passed with the condition that the council’s amendment and APC’s subsequent ratification complete the required process. The resolution and staff reports note that commercial development is still subject to future design approvals, access permits and availability of sewer and water.
