Commission recommends rezoning of Kings Lane lot for commercial use after neighbor questions

The Tullahoma Planning Commission voted unanimously to send a favorable recommendation to the Board of Mayor and Aldermen for ZMA 301, a request to rezone a parcel at 0 Kings Lane from R3 (High Density Residential) to C2 (General Commercial).
Natalie Marti, representing Hart and Family Partners, LP and speaking for Harton Realty, told commissioners the parcel historically and by tax record appeared commercial and that the applicant seeks to align the zoning with neighboring properties. “We actually thought it was commercial because when we sold the property years ago to the whole family, that was commercial,” Marti said.
Neighbor Claire Taylor of 102 Oakmont Drive—who lives behind the parcel—asked what the proposed use would be if rezoned; staff indicated the intended use would be a medical office. Senior Planner Samuel Luthy identified a scrivener’s error in earlier paperwork: the parcel is R3 (high density residential), not R2 as previously noted. Luthy described the lot as approximately 0.55 acres with roughly 290 feet of road frontage on Kings Lane and Oakmont Drive and said the future land use plan designates the area as neighborhood commercial.
Commission exchange focused on whether the application should have requested C3 instead of C2 and on differences in permitted uses between C2 and C3. Commissioners and staff discussed the practical need to allow common commercial uses—such as medical offices—in C2 and noted past updates created divergence between the two districts’ permitted uses. Staff said the proposed C2 zoning aligns with surrounding commercial zoning and infrastructure and recommended the commission send a favorable recommendation.
A motion to send a favorable recommendation was seconded (Mayor Seymour recorded as a second); the motion passed by voice vote, 6–0. The recommendation will be transmitted to the Board of Mayor and Aldermen for final action.
The commission’s vote was a recommendation only; zoning will not change until the Board of Mayor and Aldermen acts.
