Court approves lien to recover $18,000 in abatement costs for Martindale properties

Caldwell County Commissioners on June 11 adopted Resolution 162024 to assess abatement costs and place a lien on two properties in Martindale after an environmental enforcement abatement.
Environmental Enforcement staff reported that properties at 128 and 134 Sky Ridge Drive (Property IDs 28524 and 28525) were declared prohibited public nuisances under Chapter 343 of the Texas Health and Safety Code by a justice court order. The county contracted with a private contractor to abate the properties from May 13'18, 2024 at a cost of $18,000. The resolution assesses the abatement cost, adds an administrative fee of $100 and directs the county clerk to file the resolution as a lien; the resolution also provides that interest will accrue at 10% per year beginning 31 days after filing.
Staff noted the owner, identified in the resolution as Arthur Britton, had been personally served with notice and did not request or attend the justice-court hearing on November 17, 2023. The court moved, seconded and adopted the resolution by voice vote.
Next steps: upon execution, the county will file the resolution with the county clerk and the assessed costs will become a lien on the properties until paid; interest will begin to accrue as specified in the resolution.
