Fredericksburg — The City Council voted 4–1 to deny an appeal of a denied short‑term rental (STR) permit for a property at 405 North Orange Street after staff concluded the permit lapsed and the owner said a family medical emergency prevented timely renewal.
Anna (planning staff) explained the STR permit expired July 19, 2024, the nonconforming status lapsed Oct. 19, 2024, and staff does not have discretion to reinstate the nonconforming status after the statutory window. The owner described a summer in which her husband experienced life‑threatening medical events and she was the primary caregiver, saying the lapse was unintended and that the property has no recorded violations or complaints.
A council member expressed sympathy for the family circumstances but said the council’s role includes protecting community standards and enforcing ordinance deadlines. After discussion and a motion to deny the appeal, the council voted and the motion carried 4–1; one councilor voted against denying the appeal.
The council recorded the vote as four in favor of denial, one opposed. The owner was notified of the decision and thanked the council for the hearing.
