Daytona Beach approves Overlook plan and rezoning with condition to relocate and screen dumpsters

The Daytona Beach City Commission voted Nov. 20 to approve a large‑scale comprehensive plan amendment and a zoning map change for the Overlook project at 10101 Seabreeze Boulevard, allowing increased residential density and modified parking standards, and attached a condition requiring dumpsters be relocated, screened and placed to Public Works' satisfaction.

Members of the public raised concerns about parking overflow from the proposed residential conversion and repeatedly urged that nearby Ballpark Park not be used as overflow parking. John Nicholson said tenants from existing apartments frequently park in the park and asked that code and permit conditions prevent using public park property as overflow parking. Emily Nies urged better dumpster enclosures and relocation of flood‑prone dumpster pads next to the Halifax River.

Deputy City Manager Jim Morris told commissioners he had discussed the dumpster problems with the developer's representative and that the developer indicated willingness to relocate and properly enclose the north and south dumpster areas. Morris recommended adding a condition to the rezoning and amendment requiring that the dumpsters be screened and located in a manner consistent with city code and subject to Public Works' approval of access.

Commissioner Cantu moved to approve the amendment and rezoning subject to the dumpster‑relocation and screening condition; Commissioner May seconded. The motion passed on the record as "motion carries 6‑0." Commissioners and staff said the dumpster corrections would be part of the conversion Certificates of Occupancy and would incentivize timely compliance.

The public record also shows concerns about parking capacity at nearby facilities (including AdventHealth expansions) and requests for staff follow‑up to ensure on‑site parking requirements and enforcement are adequate.
