Foreweiler said his letter used an aggregate of the two most recent CPI periods and that operating costs have risen significantly over two years; staff agreed the resolution wording could be clearer and offered to edit the CPI language and reference operating cost adjustments before signatures.
Contract context and limits: City staff noted Harden’s contract allows an annual CPIU adjustment up to a 5% cap and permits pass‑throughs for certain third‑party increases (for example landfill tip fees and third‑party recycling charges), all subject to public notice and statutory hearing requirements under Idaho law. The council discussed that the city is not obligated to automatically accept future petitions but must not “unreasonably” withhold consent per the contract’s terms.
