Councilmember (unnamed) moved to ratify the change orders as presented and explicitly reserved the city’s right to file a claim against the engineering firm, Forsgren, if technical deficiencies caused the third change‑order item. The motion carried with recorded support and one abstention. Council discussion focused on whether the city should pursue an engineering deficiency claim for the drainage work and on confirming invoice and reimbursement procedures for hookups and utility work.
Staff said invoices were received and that reimbursement mechanisms would be used where appropriate for utility hookups. Council asked staff to follow up on the drainage issue and return with any recommended claims or corrective options; the reserved right to file a claim preserves that option while allowing contractors to proceed on other agreed work.
