City zoning administrator David Westfall explained the restaurant use is permitted in the B‑3 service business district but that the outdoor patio requires conditional‑use approval; off‑site parking arrangements were described as a separate, unresolved issue that would come back later.
Bob Kaplan, co‑owner of Andover Square Shopping Mall across Andover Road, told the commission he does not oppose the conditional use on principle but will not make his parking available. “I am not willing to provide parking on the Andover Square property as I do not have any spare spaces,” Kaplan said, and he warned that patrons might jaywalk across busy Andover Road, creating a public‑safety hazard.
Commissioners moved to table the matter so that applicants and staff can further investigate parking arrangements and potential traffic and safety mitigation. The motion to table passed; the application will return to the commission at a later date with additional information. The minutes will record Kaplan’s concerns for the deferred hearing.
