City staff said the restaurant use is permitted in the B-3 service business district but that the proposed outdoor patio requires conditional-use approval; off-site parking arrangements with adjacent properties had been discussed but were not finalized and would require a separate conditional-use action.
Bob Kaplan, co-owner of Andover Square Shopping Mall across Andover Road, told commissioners he would not permit his lot to be used for the applicant’s parking and warned that off-site parking would likely lead patrons to jaywalk across a busy arterial, creating a public-safety risk. “I am not willing to provide parking on the Andover Square property,” Kaplan said, citing tight supply and buses and large vehicles that already occupy stalls on his lot.
Commissioners moved to table the item to allow the applicant time to resolve parking arrangements; the motion passed with one commissioner recorded as opposed. The item will return to the commission when off-site parking and other conditions are clarified.
