Kettering council approves contract changes, bridge administration, grants and equipment purchases

Kettering City Council on Dec. 3 approved a package of ordinances and resolutions that city officials said will streamline contracting, advance a major bridge rehabilitation project, and seek state funding for pedestrian and bicycle improvements.
Council enacted an ordinance to add section 152.08 to the codified ordinances governing city contracts, a move the law department said will align municipal contract terms with recent state law. As Mr. Hamsey of the law department explained to council, “The Ohio General Assembly recently adopted Ohio revised code section 9.27 concerning provisions that are not allowed in State of Ohio contracts,” such as certain indemnification clauses and nondisclosure provisions that conflict with the Ohio Public Records Act. The council approved the ordinance by roll call.
Council also authorized the city manager to work with the Ohio Department of Transportation to administer the Galewood Street bridge rehabilitation (City project 03-928B, ODOT PID 122-768). City staff said the engineering team secured just over $1,000,000 in municipal bridge program funding for a superstructure replacement and that the city will return later for design-contract legislation. "We were recently awarded just over $1,000,000 in municipal bridge program funding," said Mr. Bergstresser.
Separately, council approved staff requests to submit three separate applications to ODOT’s Pedestrian and Bicycle solicitation for: a Far Hills Avenue road-diet project (Stroop Road to Dorothy Lane), a Research Boulevard shared-use path tied to a planned ODOT bridge replacement, and a Berwyn Park area shared-use path to connect to Marshall Road and Lincoln Park Boulevard. Staff emphasized the applications are independent and may be funded separately.
Other funding and procurement actions approved by council included:
- A $150,000 grant awarded through the FY2024 Homeland Security program (via the Ohio Emergency Management Agency) for the police department to purchase a mobile barrier system to enhance safety at community events.
- Authorization to purchase a replacement parks maintenance forklift (estimated cost $50,000), following the loss of equipment in a maintenance barn fire; staff said they expect insurance reimbursement but appropriations were approved to enable immediate procurement.
- A three-year contract with Cintas for rental and cleaning of employee uniforms, estimated at $51,850 over three years, covering street maintenance, parks maintenance and vehicle maintenance divisions as part of collective bargaining arrangements.
Council approved the measures by recorded roll calls; the transcript shows affirmative votes from the councilmembers present on each item.
