Middletown board adopts hearing officer—s findings and terminates employee No. 09278; approves personnel and audit items

The Enlarged City School District of Middletown Board of Education voted Oct. 24 to adopt a hearing officer—s findings and terminate employee No. 09278, effective Oct. 25, 2024.
Vice President Mitchell Williams read a resolution that summarized a Section 75 civil service hearing and the hearing officer—s recommendation. The resolution states that Hearing Officer Carol Mineo —found employee number 09278 guilty of all 6 charges, and recommended he be terminated from employment,— and the board voted to adopt those findings and the recommended penalty. President Ed Estrada called the voice vote and recorded the outcome as 5-0.
The board also approved routine business and personnel items. It approved the Oct. 9, 2024 meeting minutes and passed several personnel memoranda: administrative items (9A) and noninstructional items (9C) passed unanimously; instructional memorandum 9B passed with one recorded exception (item 9B12 carried 4-1 after board member John Perino withheld his vote). Financial memorandum 9D (items 1—4), special services memorandum 9E (items 1—3) and change orders (6F items 1—3) were approved by unanimous voice votes.
Audit reports presented by the audit committee were approved later in the meeting. The board accepted the 2024 internal audit (buildings and grounds) and the single-audit financial statement and management letter, including corrective action plans, on unanimous voice votes.
The public record for the termination notes that the hearing and recommendation were made under Section 75 of the Civil Service Law; the resolution says the hearing officer found substantial evidence supporting the factual findings and adopted the recommended penalty. The board moved into executive session at the end of the public meeting and did not return to public session.
