Apache Junction — The City Council unanimously approved Resolution 24-42 on Dec. 17 to correct a minor mismatch in the legal description for Superstition Vista Community Facilities District (CFD) No. 2.
Zach Sacas, special district counsel for Superstition Vista CFD No. 2, told the council the county had identified a roughly 33.5-foot discrepancy between the district boundary recorded in the development agreement and Arizona State Land records. Sacas said the amendment is limited to aligning the legal description with county records and will not increase property taxes or create new obligations for homeowners within the district.
Sacas said the district board had already approved the correction and asked the council to do likewise because the city is party to the district development financing participation and intergovernmental agreement. No public speakers raised objections, and the council approved the resolution by roll-call vote.
Council members did not request changes to the substance of the amendment. The measure was presented as a technical correction rather than a policy change affecting tax rates or services.
Next steps: The corrected legal description will be attached to the amended intergovernmental and development agreement and recorded per the governing documents and county requirements.
