Council adopts broad zoning clarifications and fixes to Title 21, removes some onerous notice requirements

On Dec. 4 the city council adopted Ordinance No. 5242, a broad set of technical and policy clarifications to the Grand Junction Zoning and Development Code (Title 21).
Planning Manager Nikki Gailhouse presented numerous amendments intended to address implementation challenges since the 2023 code adoption. Key changes included removing a requirement to post mailed neighborhood meeting notices in two public locations and on a project website (staff said sites and public posting locations were often unavailable), removing a 120-day waiting period when applicants withdraw certain applications in favor of director discretion, clarifying mailed-notice requirements for public hearings, restoring pergolas to the permitted setback encroachments table (and adding a definition), and correcting permitted-use table errors (adding duplex dwelling to the P2 district, restoring light vs heavy industrial distinctions, and fixing concealed cell tower allowances).
Other changes clarify accessory dwelling unit placement on corner lots, allow limited extensions for emergency shelters beyond 120 days where weather conditions justify it, and adjust shared-driveway and tree-preservation provisions (the planning commission recommended removing the shared-driveway cap from this ordinance to study it further). Staff said the changes resolve scrivener errors and improve code consistency; the Planning Commission recommended approval 7-0.
Council voted to adopt Ordinance No. 5242 on final passage by roll call vote, 7 to 0. Staff will bring additional refinements (for example, any shared-driveway policy adjustments) back to council as needed.
