House concurs with Senate amendment and restores fair-repair protections for agricultural equipment

The House agreed to the Senate’s proposed changes to H.81 (fair repair of agricultural and forestry equipment) with a further amendment restoring two provisions the House said were critical: (1) a private right of action holding original equipment manufacturers accountable, and (2) removal of an exemption that would have allowed OEMs to avoid the law if they had memoranda of understanding with equipment owners.
Member from Brownington, speaking for committees on Commerce and Economic Development and on Agriculture, Food Resiliency and Forestry, reviewed the differences in the Senate draft and said the amendment restores House language guaranteeing owners and independent repair providers access to parts, tools and documentation if an OEM makes them available to authorized repair providers. The amendment also updated the effective date to Jan. 1, 2025.
Committee straw polls found support for the amendment and the House concurred in the Senate proposal with the further amendment. Leadership then moved to message the House action to the Senate forthwith.
