Pacific board signs off on drainage, emergency-access design and equipment purchases

Staff said the project exceeded the original $80,000 estimate because the bid sought more depth (8 feet vs. a shallower excavation), and the board agreed the stormwater line item could absorb the overage.
Integrom Drive emergency access: The board considered Cochran’s scope for design and bidding services ($9,052) and construction-phase services ($8,600), totaling $17,652. Aldermen pressed Cochran’s contract language, raising three concerns: (1) a clause limiting Cochran’s liability; (2) a clause that would leave electronic deliverables legally owned by Cochran; and (3) indemnity provisions tied to delay damages. Attorney Jones said he routinely modifies ownership language so deliverables belong to the client and explained liability limits would be the lesser of the contract price or Cochran’s professional-liability policy. The board approved the Cochran proposal with instruction to edit clause 21 so the produced documents remain the city’s property.
Equipment and change orders: The board approved a $64,500 purchase order to Kirby Smith Machinery for an air burner (three quotes provided; budget line showed $70,000). The board also approved a $4,948 change order for KJU on the Highway N project; the vote carried 5–0–1 (one abstention recorded).
Industrial Drive stormwater: Staff reported that the Industrial Drive stormwater topographic/design proposal ($58,440) had been approved previously but work had not started; the city will now restart design work and route details through the operations committee. No construction-cost estimate was available at the time of the meeting.
What happens next: Public Works and legal staff will finalize Cochran contract edits and return executed contracts; procurement staff will proceed with purchase orders and required follow-up reporting.
