Assembly committee advances John R. Lewis Voter Empowerment Act after hours of testimony

The Assembly State and Local Government Committee voted to advance A4083, the John R. Lewis Voter Empowerment Act (NJVEA), as amended after several hours of testimony from voting-rights advocates, immigrant groups and county election officials.

Supporters said the bill would create a state-level preclearance program, expand language access and provide new tools for voters to challenge policies that suppress turnout. "The NJVEA would build on work that New Jersey has already been doing to create an inclusive state democracy," said Nuzat Choudhary of the New Jersey Institute for Social Justice. Choudhary told the committee the bill would increase resources for voters, strengthen protections against intimidation and establish a centralized elections database.

Alejandra Sorto of the ACLU of New Jersey said codifying a state preclearance mechanism is critical after federal protections were narrowed. "This legislation . . . will codify existing protections under the federal Voting Rights Act and build upon these by establishing a New Jersey-specific preclearance system," Sorto said, noting a growing racial turnout gap in recent years.

Michael Ortega of the Campaign Legal Center described how the bill would change enforcement, saying it would let voters challenge policies that create disparities in participation and would impose a notice-and-cure period to encourage local fixes before litigation. "Under the bill, voters will be able to challenge laws and policies that create disparities in voter participation," Ortega said.

Advocates for language access highlighted specific thresholds and operational details. Patrick Stegemiller of the Asian American Legal Defense and Education Fund told the committee New Jersey is linguistically diverse and cited data that "1 in 3 of the Asian population in New Jersey [is] limited English proficient, and approximately 83% speaking a language other than English at home." He supported a coverage formula that would require jurisdictions to provide language assistance at a 2% threshold or for jurisdictions with 4,000 or more limited-English-proficient voters.

Opponents or cautious stakeholders raised implementation questions. Dale Florio, appearing for county clerks and county constitutional officers, said the bill as drafted would "take the attorney general away from the individual county boards of elections as the general counsel on election matters," which he warned could lead to inconsistent legal interpretations across counties and higher local costs. Florio also said reducing language-assistance thresholds from 10% to 2% could create staffing burdens on poll operations.

The committee moved the amended bill and recorded several individual votes. Assemblywoman Swift and Assemblyman Simonson registered "no" votes; other named members present voted to release the bill from committee. Following the vote, committee members and advocates said they would continue work on details and amendments.

What happens next: A4083 was released from committee and will move to further legislative consideration. Supporters urged the full Legislature to act quickly to enact the measure.
