Putnam County Legislature Approves Appointment of Outside Counsel After Debate Over Oversight and Costs

PUTNAM COUNTY, N.Y. — Following a lengthy exchange, the Putnam County Legislature approved Veto Resolution 216 of 2024 on Nov. 25 authorizing appointment of outside counsel for the Legislature.
Opponents questioned the process and the lack of a spending cap. "We are leaving the amount open that could be spent on outside counsel," Legislator Goldman said, adding that the Legislature had recently cut an ethics board request from $25,000 to $10,000 and should apply similar oversight. Supporters said the appointment is necessary when the county attorney declares a conflict and that the Legislature must be able to secure independent representation.
Several legislators said the county attorney had declared a conflict in litigation related to a previously undisclosed lawsuit that came to the Legislature's attention after a May 2024 judicial decision. That sequence, supporters said, justified appointing outside counsel and allowing the Legislature to select its representative when the county attorney is conflicted.
A roll-call vote was recorded by the clerk (see actions[]). After the vote the clerk announced the motion to approve. The resolution as presented in the meeting did not include a specified spending cap; multiple legislators said departments could return to the Legislature for additional funds if needed.
