City staff warn Brentwood Days, temporary event structures may need floodplain "no-rise" certification

Planning staff informed the Public Works Committee on June 13 that temporary or permanent structures within mapped floodplain areas require a "no-rise" certification. That guidance from the federal/state emergency authorities means tents, stages, carnival rides and other temporary structures could need an elevation survey and engineer certification before placement — a process staff said could be operationally and administratively complex for multi-day events such as Brentwood Days.
Staff recommended a zoning text amendment to permit temporary structures within the floodplain only when accompanied by an emergency plan and a no-rise certification. Committee members raised immediate concerns about how no-rise requirements would work for large community events that rely on tents and rides set up for multiple days, and whether a same-day temporary activity falls under the requirement. Staff said in some cases, structures erected and removed the same day can avoid longer-term permitting implications, but noted the detail requires engineering analysis and could affect FEMA reimbursement eligibility for future storm damage.
The committee moved to proceed with drafting the text amendment and forwarding it to the Planning & Zoning Commission for review; staff will work with Jacobs (engineer) to analyze no-rise needs for Brentwood Days and report back as part of the formal amendment process.
