Wayne County Ethics Commission dismisses complaint against probate judge for lack of jurisdiction; approves 2024 year-end report

At its December meeting, the Wayne County Ethics Commission voted to dismiss a complaint filed by James and Helen Orsett against the Wayne County probate court and Judge Terrence Keith because staff concluded the commission lacks subject-matter jurisdiction over the Third Circuit Court and its judicial officers.

"My recommendation at this time is that the matter be dismissed for lack of subject matter jurisdiction," Mr. Longstreet, commission staff, told the board. A member moved to dismiss the complaint; the motion was seconded and carried by voice vote with members present saying "Aye" and no opposition recorded.

The commission directed staff to notify the complainants politely that the commission cannot assist in matters that fall outside its jurisdiction. Chair Thomas and Mr. Longstreet said the office has a form letter that will be used to explain the decision to James and Helen Orsett.

The board also approved the commission’s 2024 year-end report. Chair Thomas said he reviewed the report with Mr. Longstreet, members indicated they had time to review it previously, and the report was approved by motion and voice vote. "The report is approved," Chair Thomas said; he and Mr. Longstreet will sign the report and Miss Hunter will run copies after the meeting.

No members of the public registered to comment during the meeting, and the commission adjourned after brief closing remarks and expressions of thanks to Chair Thomas for his service.
