Council approves first amendment to incubator participation agreement to extend tenant term and shorten termination window

At the Dec. 9 council meeting staff presented and the council approved a first amendment to an incubator use and participation agreement originally approved June 12, 2023 between the city and Comprehensive GI Solutions.
Kristia Broadway, director of economic development, explained the amendment extends the tenant’s occupancy for another year, reduces the period for terminating without cause from 180 days to 60 days, and allows the city to adjust the incubator’s size and management approach. Council members asked about current occupancy (staff said a small percentage: one lab currently in use of an approximately eight‑unit space) and how incubator management would be handled going forward.
City counsel clarified that language about entering into an independent contractor agreement for incubator management had been removed from the amended terms; the amendment leaves discretion to the city to pursue an independent manager but does not commit to one. The council voted to approve the amendment and authorized the city manager to execute it.
