The Wauwatosa Plan Commission on a unanimous vote recommended approval of a conditional use permit for a Wingstop at 6933 West North Avenue, but denied the applicant’s request to extend operations to midnight and kept the overlay’s 11 p.m. closing time.
Planner Mr. Penon told the commission the proposed in‑building eating establishment would operate 10 a.m. to midnight if approved and that no outdoor seating was requested. "City code limits hours of operation in the North Avenue overlay zone to 11 PM, but later hours may be approved through the conditional use permit process," Mr. Penon said.
Steven Kolber, appearing by Zoom and identifying himself as an employee of the applicant, said later hours would largely support delivery and takeout operations and noted the chain’s national footprint.
Commissioner Ousman initially moved approval subject to the six conditions in the staff report and the additional hour to midnight. After discussion about nearby residences, the motion was amended to remove the extra hour; one commissioner said, "I'm in favor of the proposal with the exception of the additional hour," citing concerns about a fast‑food operation open until midnight near homes. The amendment was seconded and the commission voted in favor.
The commission’s recommendation goes to the Common Council for final action, and staff noted unchanged conditions from the staff report will apply.
