Plan Commission conditionally recommends Fox River Falls Phase 5 preliminary plat with engineering conditions

Planner Amy Bennett presented Fox River Falls Phase 5 on Nov. 12, a preliminary plat and non-substantial PRD amendment that would reintroduce single-family condo units within the PRD and keep the overall development at or below the previously approved density cap. The site contains flood fringe, floodplain and shoreland wetland, and staff recommended conditional approval subject to 31 conditions from engineering, fire, and additional conditions from Waukesha County and state regulators.

Commissioners asked about the recommended road configuration and whether engineering’s recommended connection off Landon Road could impose substantial construction and long-term maintenance costs on a condominium association. Kevin Anderson of Newman Developments said the team had discussed options with the county but had not yet obtained full county approval for dual access points; if the county allows additional access the developer said costs could be reduced. Staff noted code limits such as a 500-foot cul-de-sac maximum and that county and state approvals remain outstanding.

A motion to grant preliminary and non-substantial PRD amendment approval subject to staff and external agency conditions passed by voice vote. Commissioners emphasized that the county review and final engineering designs will determine whether the recommended road layout is feasible and whether any lot configuration changes will be necessary.
