Neighbors and nearby developers testified in opposition to any extension that would delay the original deadline in the 2019 development agreement. BlackRock Homes/DevCo said it invested adjacent to the facility in reliance on the DA condition that operations end once occupancy is permitted within 1,000 feet and urged strict enforcement. Code enforcement staff reported two on‑site inspections and verified that the Nampa site received about 47% of the specified material and that no concrete or asphalt deliveries occurred in the period cited.
Council deliberated and weighed the applicant’s revised plan, code enforcement verification, public testimony and the need to manage existing materials. Councilman Overton moved to approve H2024‑0032 as presented including the Timber Creek phase transition plans; the motion passed on a roll call vote, 5 ayes to 1 nay (Straighter).
