Babylon ZBA approves small variances, amends one renewal and reserves decision on two major redevelopments

The Town of Babylon Zoning Board of Appeals on Oct. 24 approved routine variances for several residential properties and amended one business renewal, but postponed final action on larger redevelopment projects.
In two motions taken early in the meeting the board approved application 24‑192 (Karen Capellan, represented by Richard Bronsick) — granting a west side yard reduction to allow a one‑car detached garage and a reduced front setback for a 32‑square‑foot uncovered front deck — and application 24‑169 (Stephen and Kathleen Cone, represented by Melissa Graham) with the condition that a plastic shed be removed before a certificate of occupancy is issued. Board member Shepherd made the motion to approve 24‑192 and the motion passed after standard conditions (no habitable space, no commercial use in the garage) were confirmed.
The board also amended the term of a renewal for Simply the Best Auto Collision (application 24‑179) to three years after Planning asked that the previously approved term should have been three years rather than two. That amendment passed on a board vote.
Several other matters were heard and then reserved for decision, including larger or more complicated proposals: a two‑lot subdivision on Monroe Street (applications 24‑189 a/b), a renewal for an auto‑repair special exception at 5860 Engineers Lane, a public garage renewal for 24185 (David Pena) that is subject to fire‑marshal signoff, and two major redevelopment proposals: the gas station redevelopment at Straight Path and Fulton (applications 24‑182/184) and a proposed transfer station rebuild at 45 Dale Street (application 24‑188). Both large projects drew extended presentations and technical discussion; the board closed the hearings and reserved decision.
The board routinely cited planning division and environmental control memos entered into the record and told applicants that formal decisions would be mailed after the board completes its review. For items where the fire marshal or other agencies had outstanding comments, the board said any approval would be subject to those agencies’ signoffs.
The board closed the public‑comment portions of the hearings and took no final action on the two large redevelopment applications.
