Babylon Zoning Board approves multiple variances, reserves decision on property with neighbor complaints

The Town of Babylon Zoning Board of Appeals approved a string of variances and sign renewals at its October meeting and reserved decisions on several applications pending inspections and agency reviews.
Architect Brian Fiore presented application 24176 for a North Babylon home that will be built "straight up" on the existing footprint, triggering side- and rear-yard variances; Miss McCullough moved to approve the application and the motion carried on a voice vote. The board also approved application 24174 (Nicole Laceto) with conditions that the front porch not be enclosed, the basement remain open, and any future basement bathroom be limited to two fixtures.
The board reserved decision on application 24180 (Rafael Warner) and application 24181 (Antonio Almonte and Formin Adams) pending review of revised plans and an inspection report. Miguel Ramirez, the architect for the Almonte application, described the work as adding a two‑story addition and rebuilding a shed in a conforming location; he said the basement is a finished recreation area and not used as a dwelling. Ramirez agreed to provide updated plans for the record and to allow an inspection.
The hearing for the Almonte application drew multiple public commenters. Neighbor Therese Sarish Molina said there have been repeated late‑night disturbances and alleged rooms are rented at the property: "There have been very late night parties until 3, 4, 5 in the morning. The police have been called to the point where they no longer will come," she said. The applicant and his representative denied those claims and told the board they would accept an inspection to clarify basement use.
Commercial applicants also appeared. The board renewed sign variances for 641 Wellwood Avenue LLC (application 24178) and for 367 West Babylon LLC (application 24177), approving both as amended for fixed multi‑year periods. Costello Ace Hardware (application 24175) sought approval to install two 36‑tank propane exchange cages; the board kept the record open for the required fire prevention permit and the fire marshal's report and the applicants agreed to a delivery window of 8 a.m. to 4 p.m.
Board members said written decisions will be mailed after outstanding inspections and agency responses are received. Where the record was left open, the board emphasized that applicants must submit revised plans or supporting agency clearances before formal rulings are issued.
