Council continues one easement petition, vacates easements tied to Vermilion Valley realignment
Summary
Council continued a petition to vacate a drainage/utility easement over Outlot D (to Jan. 21) and adopted Resolution 2024 Tech 112 to vacate certain easements within Outlot A of the Vermilion Valley Development to accommodate Spruce Street realignment.
Farmington — On Dec. 16 the Farmington City Council took two separate actions on easement matters connected to local development.
1) Drainage-utility easement (Outlot D, Vermillion Grove). City staff requested a continuance of the public hearing on a petition to vacate a drainage/utility easement because the applicant is updating the plat for the proposed Aiken Knoll plat. Council voted to continue that hearing to the Jan. 21, 2025 regular meeting so the plat can be finalized before any easement change is approved.
2) Vermilion Valley (Outlot A) easements. Staff described a planned reconstruction and realignment of the Duchenne Parkway/Spruce Street intersection tied to the Rye apartment project and related development. A permanent easement executed by Adelman Farm LLC will provide a 35-foot public roadway, drainage, utility, trail and landscaping easement through Outlot A. To accommodate the relocation and right-of-way adjustments, staff recommended and the council adopted Resolution 2024 Tech 112 vacating the easements shown in staff materials.
Council made clear the vacatur is tied to the developer platting and the executed permanent easement. The staff presentation cited statutory public-notice requirements had been met and recommended adoption after public comment (none were offered). Council approved the resolution on roll-call vote.
