Lewisville —7 Jan. 8, 2024 —6 The City Council adopted a resolution authorizing staff to pursue acquisition of fee simple title to a parcel intended for a public park known as Glory Park (Parque La Gloria), including authority to appoint an appraiser and, if necessary, commence condemnation proceedings.
Staff said the parcel described in the caption is approximately 3,599 square feet and that a partial release of an access easement of about 4,564 square feet is also being considered. The property at 301 East Southwest Parkway is planned for development as a public park; staff reported attempts to negotiate a voluntary sale but said the owners did not respond to offers.
Under Texas Property Code and the Texas Government Code process cited in the agenda caption, the city must make a bona fide offer prior to initiating eminent-domain proceedings. Council moved, seconded and approved the resolution unanimously. The motion authorized the city manager or designee to establish just compensation and to take required steps under applicable law should condemnation be necessary.
Next steps: staff will proceed with appraisal and negotiation efforts and report back to council as required by state law.
