Dr. James Kirk, president of the ODC, summarized the agreement and told council the ODC had reviewed the matter at a special session and approved it 3-1. Under the agreement, DGK will construct qualified infrastructure and may be reimbursed up to $7,834,733 as phases are completed and inspected by the city/ODC. Dr. Kirk and other speakers emphasized traffic-flow benefits and job creation tied to an anticipated new private school, housing and retail in the area.
Council and members of the public raised due-diligence questions about project timing, annexation prospects for parcels located in part within Midland County, environmental and appraisal documents, and whether the ODC had sufficient review by compliance committees. ODC board members and public commenters said environmental reports and due-diligence materials (phase 1/2 studies and appraisals) were available and that the property had attracted multiple bidders.
Council voted to approve the resolution authorizing the performance agreement. The agreement is reimbursement-based: DGK will submit invoices and receive payment after city/ODC inspections verify completion of specified stages. Council and ODC leaders said they had placed safeguards into the reimbursement/inspection process to avoid payment without approval.
